Welcome to Home Therapist Cooling, Heating, and Plumbing (“Home Therapist,” “we,” “us,” or “our”). These Terms and Conditions (“Terms”) govern your use of our website and the services we provide. By accessing or using this website, requesting an estimate, booking a service, or entering into a service agreement with us, you agree to be bound by these Terms. If you do not agree, please do not use our website or services.
1. Company Information and Licensing
Home Therapist Cooling, Heating, and Plumbing is a Florida-licensed HVAC and plumbing contractor serving Tampa Bay and surrounding areas. Our licenses are issued by the Florida Department of Business and Professional Regulation (DBPR):

- Plumbing License: CFC1431159
You may verify these licenses at myfloridalicense.com. Home Therapist carries general liability insurance and workers’ compensation coverage as required by Florida law. Certificates of insurance are available upon request.
2. Service Scope
We provide residential and commercial HVAC and plumbing services in the Tampa Bay area, including installation, repair, replacement, maintenance, and emergency service. All service offerings are detailed on our website and may be subject to availability, parts inventory, and technician scheduling. We reserve the right to decline any service request at our discretion.
3. Estimates, Diagnostics, Pricing, and Payments
Free Estimates and Free Diagnosis: All estimates are provided free of charge and are non-binding. Diagnostic visits to identify a problem are also free; we do not charge a separate diagnostic, trip, or service-call fee.
Approved Repairs: When you approve a repair, a minimum labor charge of $279 applies. This minimum covers the labor for completing any approved repair work and is not a diagnostic fee. Parts, materials, and additional labor beyond the minimum are billed separately based on the scope of work.
Final Pricing: Final pricing may vary based on on-site inspection, parts availability, code requirements, and the scope of work actually performed. You will receive a written estimate before any approved repair work begins.
Payment Terms: Payment is due upon completion of service unless otherwise agreed in writing. We accept major credit cards, ACH, and approved financing. Returned payments may incur a fee of up to $35 plus any costs incurred. Past-due balances may accrue interest at the maximum rate allowed by Florida law.
Financing: Financing is offered through third-party lenders, subject to credit approval. Terms, rates, and approval are determined solely by the lender, not by Home Therapist.
Refunds: Diagnostic visits are free and not subject to refund. Labor performed and parts installed are generally non-refundable. If you believe a charge is in error, contact us within 14 days of service and we will work to resolve the issue in good faith.
4. Cancellation and Rescheduling
You may cancel or reschedule a non-emergency appointment by contacting us at (813) 343-2212 with at least 24 hours’ notice at no charge. Cancellations or no-shows with less than 24 hours’ notice may incur a trip charge. Emergency calls and same-day appointments are non-refundable once a technician has been dispatched.
5. Warranties and Guarantees
Workmanship: Home Therapist warrants its labor on installations and repairs for a period stated on the invoice or service agreement (typically one year on standard repairs, longer on equipment installations).
Manufacturer Warranties: New equipment carries the manufacturer’s warranty, which is separate from our workmanship warranty. Manufacturer warranty terms, durations, and conditions are set by the manufacturer and may require product registration, regular maintenance, and the use of authorized parts. Modifications, unauthorized repairs, or installation of non-OEM parts by others may void the manufacturer warranty.
Limitations: Warranties do not cover damage caused by misuse, neglect, accident, power surges, flooding, hurricane damage, freeze damage, pest infestation, lack of maintenance, or work performed by anyone other than Home Therapist or an authorized representative.
Claims: To make a warranty claim, contact us at (813) 343-2212 or service@callhometherapist.com with your invoice number. We will schedule a service visit promptly. Warranty service is performed during normal business hours unless emergency conditions exist.
6. Permits and Code Compliance
Certain installations and replacements require permits issued by the local Authority Having Jurisdiction (Hillsborough County, Pinellas County, Pasco County, or municipal building departments). When a permit is required, Home Therapist will pull the permit and schedule the necessary inspections. Permit and inspection fees are passed through to the customer at cost and itemized on the invoice. All work is performed to comply with the Florida Building Code and applicable local amendments.
7. Hazardous Materials and Environmental Notices
Refrigerants: Home Therapist technicians are EPA Section 608 certified. We handle, recover, and dispose of refrigerants in accordance with EPA regulations. Equipment using R-22 (phased out) and R-410A (phasing out 2025-2026) may require special handling or replacement.
Pre-1989 Plumbing: Homes built before 1989 may contain lead solder or lead piping. Polybutylene piping (common 1978 to 1995) is prone to failure. If we encounter these materials during service, we will discuss replacement options with you before proceeding.
Asbestos and Mold: Older ductwork, pipe insulation, and building materials may contain asbestos. If we suspect asbestos, mold, or other hazardous materials during a service visit, we will stop work and refer you to a licensed remediation specialist. Home Therapist is not licensed to abate asbestos or perform mold remediation.
Customer Responsibility: You agree to disclose any known hazardous materials, prior repairs, or unusual conditions at the property before service begins.
8. Customer Responsibilities
You agree to provide safe and reasonable access to the property, including any equipment, attic spaces, crawl spaces, and electrical panels needed to perform the service. You agree to disclose pre-existing damage, prior repairs, or any condition that may affect service delivery. Delays, additional work, or damage caused by undisclosed conditions, blocked access, pests, or hazardous environments may result in additional fees or rescheduling.
9. Communications Consent (Calls, Text Messages, Email)
By providing your phone number when you request service, book an appointment, or contact us, you expressly consent to receive calls and text messages from Home Therapist or our authorized service providers at that number for purposes including appointment scheduling, technician arrival updates, invoice delivery, service follow-up, warranty notices, and (where you have separately opted in) promotional messages.
Calls and text messages may be delivered using automated technology. Message and data rates may apply. Message frequency varies based on your activity. You may opt out of marketing messages at any time by replying STOP to any text or by contacting us at (813) 343-2212. Opting out of marketing does not stop transactional messages related to scheduled service.
You also consent to receive service-related email at any address you provide. You may opt out of marketing email by clicking the unsubscribe link in any marketing message.
10. Call Recording Disclosure
For quality assurance, training, and dispute resolution, telephone calls to and from Home Therapist may be recorded. Florida is a two-party (all-party) consent state under FL Statute 934.03. By continuing a recorded call after notice, you consent to the recording. If you do not consent to being recorded, please notify the agent at the start of the call and we will end the call or continue without recording.
11. Photography and Marketing Use
Our technicians routinely take photographs of equipment, work areas, and installations as part of our standard service documentation, warranty record, and quality control. These photographs are stored in our service management system (Housecall Pro) and may also be used by Home Therapist in marketing materials, social media, our website, and other promotional channels.
Photographs are limited to equipment and work areas and do not include identifying information about you or the interior of personal living spaces beyond what is necessary to document the service. If you do not want photographs of your property used for marketing, notify the technician on site or contact us at service@callhometherapist.com before or during the service visit. Removing previously published images may take 30 to 60 days.
12. Limitation of Liability
To the fullest extent permitted by Florida law, Home Therapist shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including but not limited to lost profits, lost revenue, loss of data, loss of use, or property damage that is not directly caused by our negligence. Our total liability arising out of or relating to any service shall not exceed the amount paid by the customer for the specific service giving rise to the claim. Nothing in this section limits liability that cannot be limited under Florida law.
13. Indemnification
You agree to indemnify, defend, and hold harmless Home Therapist, its owners, employees, contractors, and authorized representatives from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) any pre-existing condition at the property, (b) your breach of these Terms, (c) any unauthorized modification or repair performed by you or others after our work is completed, or (d) your violation of any law or third-party rights in connection with the service.
14. Force Majeure
Home Therapist is not liable for delays or failures in performance caused by events beyond our reasonable control, including but not limited to hurricanes, tropical storms, flooding, extreme weather, fires, government orders, pandemics, supply chain disruptions, parts shortages, manufacturer recalls, labor shortages, utility outages, or acts of war or terrorism. We will make reasonable efforts to notify you of delays and to reschedule promptly when conditions allow.
15. Intellectual Property
All content, branding, logos, trademarks, photographs, and images on this website are the property of Home Therapist or licensed to Home Therapist and may not be copied, reused, or distributed without our prior written permission. Customer reviews and testimonials remain the intellectual property of the reviewer, used with permission.
16. Third-Party Tools and Service Providers
We use third-party platforms to operate our business. By using our services, you acknowledge that your information may be processed by these providers under their own terms and privacy policies:
- Housecall Pro (scheduling, invoicing, customer communication, photo storage): Terms of Service
- GoHighLevel (CRM, lead pipeline, voice AI)
- Zoho Mail (email)
- Make.com (workflow automation)
- QuickBooks Online (accounting and invoicing)
- Google and Meta (advertising, analytics, customer reviews)

17. Florida Construction Lien Law Notice (FL Statute 713)
ACCORDING TO FLORIDA’S CONSTRUCTION LIEN LAW (SECTIONS 713.001 TO 713.37, FLORIDA STATUTES), THOSE WHO WORK ON YOUR PROPERTY OR PROVIDE MATERIALS AND SERVICES AND ARE NOT PAID IN FULL HAVE A RIGHT TO ENFORCE THEIR CLAIM FOR PAYMENT AGAINST YOUR PROPERTY. THIS CLAIM IS KNOWN AS A CONSTRUCTION LIEN. IF YOUR CONTRACTOR OR A SUBCONTRACTOR FAILS TO PAY SUBCONTRACTORS, SUB-SUBCONTRACTORS, OR MATERIAL SUPPLIERS, OR NEGLECTS TO MAKE OTHER LEGALLY REQUIRED PAYMENTS, THE PEOPLE WHO ARE OWED MONEY MAY LOOK TO YOUR PROPERTY FOR PAYMENT, EVEN IF YOU HAVE PAID YOUR CONTRACTOR IN FULL. IF YOU FAIL TO PAY YOUR CONTRACTOR, YOUR CONTRACTOR MAY ALSO HAVE A LIEN ON YOUR PROPERTY. THIS MEANS IF A LIEN IS FILED YOUR PROPERTY COULD BE SOLD AGAINST YOUR WILL TO PAY FOR LABOR, MATERIALS, OR OTHER SERVICES THAT YOUR CONTRACTOR OR A SUBCONTRACTOR MAY HAVE FAILED TO PAY.
For projects exceeding $2,500, you may be asked to sign a separate Notice of Commencement and to provide releases of lien before final payment.
18. Governing Law and Venue
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles. Exclusive venue for any legal action not subject to arbitration shall lie in the state or federal courts located in Hillsborough County, Florida, and you consent to the jurisdiction of those courts.
19. Dispute Resolution and Arbitration
Informal Resolution First: Before filing a formal claim, the parties agree to attempt to resolve any dispute by contacting us in writing at service@callhometherapist.com or 1408 W Linebaugh Ave, Tampa, FL 33612. We will respond within 30 days.
Binding Arbitration: If informal resolution fails, any dispute, claim, or controversy arising out of or relating to these Terms or any service we provide (other than claims for injunctive relief, small-claims-court matters under $8,000, or actions to enforce Home Therapist’s licenses or liens) shall be resolved by binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. The arbitration shall take place in Hillsborough County, Florida.
Class Action Waiver: You and Home Therapist agree that each may bring claims only in an individual capacity and not as a plaintiff or class member in any purported class, collective, or representative action.
Opt-Out: You may opt out of this arbitration provision by sending written notice to service@callhometherapist.com within 30 days of first agreeing to these Terms, stating your name, address, and intent to opt out.
20. General Provisions
Entire Agreement: These Terms, together with any written service agreement or invoice, constitute the entire agreement between you and Home Therapist regarding the services and supersede any prior agreements.
Severability: If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in full force and effect.
No Waiver: Our failure to enforce any provision of these Terms is not a waiver of our right to enforce it later.
Assignment: You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign these Terms to any successor or affiliate.
Survival: Sections relating to payment, warranties, limitation of liability, indemnification, dispute resolution, and governing law survive termination of any service relationship.
21. Changes to These Terms
We may update these Terms from time to time. The “Last Updated” date at the top of this page reflects the most recent revision. Material changes will be highlighted on the page or communicated by email or text where required by law. Continued use of our website or services after the effective date of any change constitutes your acceptance of the updated Terms.
