These Terms of Use (“Terms”) apply to callhometherapist.com, our online booking and pricing tools, our customer portal at hometherapist.pro, and our calls, texts and emails. They are between you and The AC Therapist LLC, a Florida limited liability company doing business as Home Therapist Cooling, Heating, and Plumbing (“we,” “us”). By using the website, booking, or contacting us, you agree to these Terms. SECTION 17 REQUIRES INDIVIDUAL ARBITRATION AND WAIVES CLASS ACTIONS AND JURY TRIALS.

1. Who we are

2. Work we perform

Every job is governed by our Service Agreement, at callhometherapist.com/service-agreement/, together with the written estimate you approve. If these Terms and the Service Agreement conflict about a job, the Service Agreement controls.

3. Prices and information on this website

  • Prices, ranges, calculators, online quotes and other information on this website are general information and estimates. They are not offers and do not bind us.
  • Your price is the one on the written estimate you approve after we see the job. Prices can change with the equipment, the conditions at your home, code requirements and supplier pricing.
  • We may correct errors on the website at any time, including after you book.
  • Content on this website is general information, not professional advice for your home. Do not attempt gas, electrical or refrigerant work yourself.

4. Diagnosis and trip fees

Inside our service area we currently offer free diagnosis with no trip charge. Outside our service area, any trip fee is told to you before we book the visit. You approve a written price before any repair or installation begins.

5. Online booking

  • An online booking is a request. It is confirmed when we confirm it by text, email or phone.
  • We give you an arrival window. Times can change because of weather, emergencies and earlier jobs.
  • We may decline or reschedule any request, including requests outside our service area.

6. Rescheduling and missed appointments

Please give us at least 24 hours’ notice to cancel or reschedule. We do not charge a fee for a missed service call. After two missed appointments without notice, we may ask for a deposit before booking again. For installations, if you cancel after we order equipment or apply for a permit, the cancellation terms in the Service Agreement apply.

7. Payments

Payment terms are in the Service Agreement. Returned checks and payments are charged the service fee allowed by Section 68.065, Florida Statutes, plus bank fees. Past-due balances accrue interest at 1.5% per month (18% per year) or the highest rate allowed by law, whichever is lower. Financing is offered by independent lenders and lease companies, subject to their approval and terms.

8. Text messages

  • Service messages. When you give us your mobile number to book, request a quote or receive service, you agree to receive texts about your appointments, estimates, invoices, payments, warranty and service, including automated texts.
  • Marketing messages. We send marketing texts, such as offers and maintenance reminders, only if you separately agree to receive them. Consent to marketing texts is not a condition of any purchase.
  • Message frequency varies. Message and data rates may apply. Reply HELP for help or STOP to stop texts at any time. After STOP, we may send one message confirming you opted out.
  • Carriers are not liable for delayed or undelivered messages.
  • You confirm you are the subscriber or regular user of the number you give us, and you agree to tell us if it changes.

9. Calls, chat and email

Calls to and from us may be recorded and transcribed for quality, training and records, and you are told at the start of the call. Some calls, texts and chats may be answered by an automated assistant. You may ask for a person or ask not to be recorded. You may unsubscribe from marketing email at any time using the link in the email.

10. Reviews and things you send us

  • We welcome honest reviews on any platform. We never pay for reviews, and nothing in these Terms limits your right to post an honest review.
  • If you send us photos, videos, reviews or comments, or post them on our pages, you give us a free, non-exclusive, permanent license to use, copy and share them in connection with our business, including on our website and social media. You confirm you have the right to share them.

11. Using this website

You agree not to submit false bookings or someone else’s information, copy or scrape the website by automated means, interfere with its security or operation, or use it for anything unlawful. We may block anyone who does.

12. Our content

The website’s content, photos, logos and trademarks belong to us or our licensors. You may view and share pages for personal use. Any other use needs our written permission.

13. Other websites

Links to lenders, review sites, manufacturers and other websites are for your convenience. We do not control them and are not responsible for them.

14. Website disclaimer

The website and online tools are provided “as is” and “as available.” To the extent the law allows, we disclaim all warranties about the website, including accuracy, availability and fitness for a particular purpose. Warranties for our work are stated only in the Service Agreement.

15. Limit on website liability

To the extent the law allows, we are not liable for indirect or consequential damages from using the website, and our total liability for any claim about the website is limited to $100. This section does not apply to work we perform, which is governed by the Service Agreement.

16. Indemnity

You agree to indemnify us for claims and costs, including reasonable attorney’s fees, caused by your misuse of the website or your breach of these Terms.

17. Disputes

Any dispute about the website, booking, or our calls, texts or emails (including TCPA and FTSA claims) is resolved under the pre-claim notice, arbitration, class action waiver, small claims, opt-out and jury waiver terms in Section 30 of our Service Agreement, which apply to these Terms as if written here. Florida law governs, and any court case must be filed in Hillsborough County, Florida.

18. General

If any part of these Terms is unenforceable, the rest stays in effect. Not enforcing a term once does not waive it. We may assign these Terms. We may update these Terms by posting a new version with a new effective date. The version in effect when you book applies to that booking.
